Official regulation and consolidated text

Royal Decree 706/2017 of 7 July approved the complementary technical instruction ITC MI-IP 04, “Instalaciones para suministro a vehículos” within the Spanish petroleum installation framework. It came into force on 2 November 2017. The BOE's consolidated text incorporates amendments published up to June 2020.

Where does MI-IP 04 apply?

MI-IP 04 governs technical requirements for installations supplying fuels to vehicles. It addresses new installations, their modifications and expansions, as well as certain provisions applicable to existing installations, notably leak detection and related tests. The scope must be assessed from the actual installation and the applicable transitional provisions, not simply from the product name.

Mixed energy facilities may also be subject to other technical rules for LPG, compressed or liquefied natural gas, and electric vehicle charging systems.

Tanks, tanker unloading areas and fuel dispensers

The instruction defines the installation's storage area, the tanker unloading area and the vehicle fuelling area, among others. Its technical chapters cover tank installation, ancillary equipment, dispensers, piping, environmental protection, leak-detection systems, tests and applicable administrative procedures.

For fuel deliveries, the design of fill points, connections, spill prevention, tanker stopping position and safe operating arrangements needs to be reviewed against the actual installation and fuel.

What is covered by MI-IP 04 and what is covered by ADR?

MI-IP 04 concerns the installation and its regulated construction, equipment and operation. ADR concerns the carriage of dangerous goods by road and applicable obligations for vehicle, driver, tank, documentation and transport operations. A requirement or exemption under one framework does not automatically determine the result under the other.

For example, electrical bonding and earthing arrangements at a road tanker delivery point require a review of the actual fuel properties, equipment and applicable installation and ADR provisions. Avoid applying a universal rule merely because a material is sold as diesel or jet fuel.

Operational documentation and periodic review

Check the installation's authorisation or notification, as-built documentation, product characteristics, operating instructions, relevant inspections and maintenance, spill controls and the emergency plan. Where a road tanker is used, separately verify ADR applicability and the responsibilities assigned to the participating businesses.
