CHAPTER V
Principle of effectiveness throughout the national territory

Article 19. Economic freedom throughout the national territory.

  1. From the moment an economic operator is legally established in a place within Spanish territory, they may carry out their economic activity throughout the territory, with or without physical establishment, provided they meet the access requirements to the activity of the place of origin, even when the economic activity is not subject to requirements in that place.
  2. Any product legally produced under the regulations of a place within Spanish territory may circulate and be freely offered in the rest of the territory from the moment it is placed on the market.
  3. When, according to the regulations of the destination, requirements, qualifications, prior controls, or guarantees are required from economic operators or goods, different from those required or obtained under the regulations of the place of origin, the destination authority will assume the full validity of the latter, even if they differ in scope or amount. Likewise, free exercise shall operate even when no requirement, control, qualification, or guarantee is required under the regulations of the place of origin.

Second additional provision. Regulated products.
Without prejudice to the provisions of Article 19.2 of this Law, the placing on the market of products subject to monopolies, explosives, professional diesel, and dangerous goods must comply with the sales conditions established in the applicable state regulations.
