Royal Decree 506/2013, of June 28, on fertilizers.

Article 8. Packaging.

  1. For a product to be considered packaged, its packaging must be closed in such a way or by means of a device that upon opening, the closure, the seal of the closure, or the packaging itself is irreversibly damaged. The use of valve sacks will be allowed.
  2. Any product that does not comply with the provisions of the preceding paragraph shall be considered bulk.
  3. The following products must be packaged:

a) Fertilizers based on ammonium nitrate with a high nitrogen content specified in Article 25 of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003, as well as mixed fertilizers provided for in group I of Annex I to this Royal Decree that use ammonium nitrate as an ingredient and whose nitrogen content due to ammonium nitrate is greater than 16 percent by mass, when supplied to the end user.

b) Inorganic fertilizers with micronutrients from group 1.3 of Annex I, except those of type 1.3.5, from their manufacture to the end user.

c) Fertilizers classified as dangerous, in accordance with Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008, on classification, labeling and packaging of substances and mixtures, or in accordance with Royal Decree 255/2003, of February 28, approving the Regulation on classification, packaging and labeling of hazardous preparations, during the transitional period provided for in Article 61.1, second paragraph of Regulation (EC) No 1272/2008. However, these fertilizers may be transported in bulk when this operation is carried out in accordance with the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), done at Geneva on 30 September 1957 and ratified by Spain, and its Annexes A and B in force.

Article 9. Labeling.

  1. In «CE fertilizers,» the labels and all documentation or information accompanying the product must comply with the labeling rules of Regulation (EC) No 2003/2003 of the European Parliament and of the Council of 13 October 2003. The nutrient contents shall be expressed as follows:

a) Nitrogen, only as an element (N).

b) Phosphorus and potassium, as oxides (P2O5 and K2O).

c) Calcium, magnesium, sodium, and sulfur, as oxides (CaO, MgO, Na2O, and SO3).

  1. For other fertilizers, the general identification and labeling provisions detailed in Annex II shall be respected, and, in addition, the following rules shall be taken into account:

a) Labels or printed indications on the packaging containing the data referred to in Annex II shall be placed in a clearly visible location.

b) If the information is not printed on the packaging, the labels shall be affixed to the packaging or its closure system. If the closure system consists of a seal or seal, it shall bear the name or brand of the packager.

c) The labeling must be and remain indelible and clearly legible.

d) In the case of bulk fertilizers, the merchandise must always be accompanied by a copy of the accompanying documents. This copy of the documents must be accessible to control bodies.

e) The mandatory indication of the manufacturer of the product refers, in accordance with Article 2.46, to the person responsible for placing it on the market, and shall specify whether it is the producer, importer, packager, etc.

f) The label, the indications on the packaging, and the accompanying documents must be written, at least, in the official Spanish language of the State.

Article 10. Content of labels and accompanying documents.

  1. The only indications regarding the product that will be allowed on labels and accompanying documents will be the mandatory and optional identifications and mentions of Annex II. Any other information appearing on the packaging must be clearly separated from the indications on the label.
  2. The information included on the packaging, labels, accompanying documents, advertising, and presentation of the product shall in no case be misleading to the consumer or contain statements contrary to the basic principles of plant nutrition or agricultural soil fertilization.
  3. The label or accompanying documents of products classified as hazardous, in accordance with the regulations of paragraph 3(c) indicated in Article 8, must contain the hazard pictograms, warning words, hazard statements, and precautionary statements established in Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 or the hazard symbols and indications, risk phrases (R phrases), and precautionary phrases (S phrases) established in Royal Decree 255/2003 of 28 February, during the transitional period.
