The Technical Instructions for the Safe Transport of Dangerous Goods by Air approved by the International Civil Aviation Organization (ICAO) (Doc. 9284-AN/905), which complement the general provisions contained in Annex 18 to the Chicago Convention on International Civil Aviation, were incorporated into Spanish law by Royal Decree 1749/1984, of August 1, approving the National Regulation on the safe transport of dangerous goods by air and the Technical Instructions for the safe transport of dangerous goods by air.
The International Civil Aviation Organization (ICAO) has introduced a series of amendments to the Technical Instructions for the Safe Transport of Dangerous Goods by Air, the last revision of which was carried out by order of the Minister of Public Works in 2011.
This order aims to update the aforementioned Technical Instructions in accordance with the amendments contained in the 2013-2014 edition of the aforementioned ICAO document (Doc. 9284-AN/905), under the authority contained in the second final provision of Royal Decree 1749/1984, of August 1, which authorizes the Minister of Public Works to modify, subject to favorable reports, where appropriate, from the competent Ministries and the mandatory report from the Commission for the Coordination of the Transportation of Dangerous Goods, the annexes to said royal decree in the following cases:
a) when amendments are introduced by the International Civil Aviation Organization (ICAO) in Annex 18 to the Chicago Convention or in the Technical Instructions (ICAO, Doc. 9284-AN/905);
b) when deemed necessary, upon proposal by the competent ministries.
Therefore, with the favorable reports of the Ministries of Foreign Affairs and Cooperation, Defense, the Interior, Industry, Tourism and Trade, Environment and Rural and Marine Affairs, Health, Social Policy and Equality, and the mandatory report from the Commission for the Coordination of the Transportation of Dangerous Goods, and in accordance with the Council of State, I hereby decree:
Sole Article. Amendment of Royal Decree 1749/1984, of August 1, approving the National Regulation on the Safe Transport of Dangerous Goods by Air and the Technical Instructions for the Safe Transport of Dangerous Goods by Air.
The content of the Technical Instructions for the Safe Transport of Dangerous Goods by Air, contained in Annex 2 of Royal Decree 1749/1984, of August 1, approving the National Regulation on the Safe Transport of Dangerous Goods by Air and the Technical Instructions for the Safe Transport of Dangerous Goods by Air, is updated, which are worded as set forth in the annex to this Order.
Sole Derogatory Provision. Regulatory repeal.
Order FOM/3553/2011, of December 5, amending Annex 2 of Royal Decree 1749/1984, of August 1, approving the National Regulation on the Safe Transport of Dangerous Goods by Air and the Technical Instructions for the Safe Transport of Dangerous Goods by Air, is hereby repealed.
First Final Provision. Title of competence.
This order is issued under the exclusive competence conferred on the State by Article 149.1.20 of the Constitution regarding air space control, air traffic, and air transport.
Second Final Provision. Entry into force.
This order shall enter into force on the day following its publication in the Official State Gazette.
