BOOK – OCCUPATIONAL HEALTH AND SAFETY IN THE TRANSPORTATION OF DANGEROUS GOODS BY ROAD

The sector of road transportation of dangerous goods is subject to a multitude of occupational hazards of varying severity, which put workers involved in the activity, particularly professional drivers and personnel responsible for loading and unloading these goods at workplaces, in a compromised situation. Despite this, this sector does not have specific regulations that develop Law 31/1995, of November 8, on Prevention of Occupational Risks (LPRL), taking as a reference the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR). This fact represents a significant obstacle for transport companies and those loading or unloading these goods in terms of protecting the health of their workers. Therefore, the national legislator must make an effort to approve a preventive standard that addresses this activity particularly from the perspective of the worker as the recipient of protection, thus reinforcing safety in an inherently problematic and dangerous activity.

Consequently, this work addresses road transportation of dangerous goods as well as the operations before and after it, analyzing the set of occupational hazards faced by workers in the sector, developing, in detail, the entire regulatory framework affecting the activity from a multidisciplinary perspective given the existence of a large number of regulations on the transportation of goods from national and international legal sources: LPRL, Royal Decree 551/2006, of May 5, Traffic Law, ADR, etc. Likewise, it extensively studies this productive sector analyzing, on one hand, all the participants in it, with special emphasis on the self-employed transporter and the economically dependent self-employed worker —both very present in this sector of activity— and, on the other hand, training and working time, as well as the obligations and corresponding corporate responsibilities arising from their omission or non-compliance.
