The Royal Decree 255/2003, of February 28, approving the Regulation on the classification, packaging, and labeling of dangerous preparations, incorporated into our legal system Directive 1999/45/EC of the European Parliament and of the Council of May 31, 1999, on the approximation of the laws, regulations, and administrative provisions of the Member States of the European Union relating to the classification, packaging, and labeling of dangerous preparations.

Annex VI of this royal decree, which coincides with that of the same number of the Directive, contains a list of Member States. Order PRE/3/2006, of January 12, which modified Annex VI of the Regulation on the classification, packaging, and labeling of dangerous preparations, approved by Royal Decree 255/2003, of February 28, amended this list due to the accession of ten new Member States to the European Union. Subsequently, Order PRE/1648/2007, of June 7, which modified Annex VI of the Regulation on the classification, packaging, and labeling of dangerous preparations, approved by Royal Decree 255/2003, of February 28, again modified the list due to the accession of two new Member States to the European Union.

Recently, and in accordance with the provisions of the Accession Act of Croatia to the European Union, this list has been modified again to include this new Member State, which is carried out by the provisions of point 2 of the annex to Council Directive 2013/21/EU of May 13, 2013, adapting Council Directive 67/548/EEC and Directive 1999/45/EC of the European Parliament and of the Council in the field of the environment, due to the accession of the Republic of Croatia.

Consequently, it is necessary to replace the list of States contained in Annex VI of the Regulation on the classification, packaging, and labeling of dangerous preparations, approved by Royal Decree 255/2003, of February 28, with the list in the annex to this order.

In the preparation of this provision, the affected sectors have been heard.

This order, issued under the powers conferred by the second final provision of Royal Decree 255/2003, of February 28, partially incorporates into our legal system Council Directive 2013/21/EU of May 13, 2013, specifically, those of its provisions that affect Council Directive 1999/45/EC of the European Parliament and of the Council of May 31, 1999.

By virtue of the foregoing, at the proposal of the Minister of Health, Social Services and Equality, and the Ministers of Industry, Energy, and Tourism, and of Agriculture, Food, and Environment, in accordance with the State Council, I hereby provide:

Single article. Amendment of Annex VI of the Regulation on the classification, packaging, and labeling of dangerous preparations, approved by Royal Decree 255/2003, of February 28.

In point 5 of Part A of Annex VI of the Regulation on the classification, packaging, and labeling of dangerous preparations, approved by Royal Decree 255/2003, of February 28, the list of States contained therein is replaced by the one set out in the annex to this order.

First final provision. Incorporation of European Union law.

By means of this order, section 2 of the annex to Council Directive 2013/21/EU of May 13, 2013, adapting Council Directive 67/548/EEC and Directive 1999/45/EC of the European Parliament and of the Council in the field of the environment, due to the accession of the Republic of Croatia, is incorporated into Spanish law.

Second final provision. Entry into force.

This order shall enter into force on the day following its publication in the «Official State Gazette.»
