JUSTIFICATION AND OBJECTIVES:

Until the entry into force of ADR 2019, Shippers of Dangerous Goods have not been required to appoint a Security Advisor, and therefore have not undergone the verification examinations established in ADR.

It is also necessary to consider that the Dispatch Activity is not included in Royal Decree 97/2014, in a similar way to the loading or unloading of Dangerous Goods, although there are provisions in this Regulation that affect the shipper.

The basic difference between the activities of packaging, loading, filling, unloading and transport and that of Expedition is that the latter does not include operations in which Dangerous Goods are physically involved, but rather they are administrative, management, organisation and control activities.

It is very likely that the Shippers have carried out their activity without considering other factors than the commercial and administrative ones, from which it is derived to carry out the essential actions for the management of the dispatch of the goods and to take the logical precautions to avoid damage to the products sent and the possible sanctions derived from the infractions that could be committed.

For all these reasons , as a Shipper, it is necessary to consider the following:

Are you aware of all the Safety and Operational Obligations assigned by the ADR and RD 97/2014 and, additionally, by the general regulations applicable to the transport of Dangerous Goods?

Do you know how to comply with these regulatory provisions and obtain the supporting elements for having carried them out?

The objectives of this course are to make known all the security and operational obligations assigned to the Shippers, their actions before and after the start of the expeditions and how to carry them out successfully, and which are the documents that justify the fulfillment of said Obligations.

CONTENT PROGRAMMING

EVERYTHING YOU SHOULD KNOW:

  • General considerations on essential elements that affect Shippers: on ADR, Training and Qualification of all Participants, contracting of Services by the Shipper, among others.
  • What are the Dangerous Goods that can be shipped, their Form of Transport and the Modes of Transport that will be used to carry out each transport operation.
  • What are the characteristics, functions and actions that define the Shipper?
  • What actions must the Shipper take before and after starting the shipment?

…AND SECURITY OBLIGATIONS:

Before starting the shipment

  • Check the correct Classification of Dangerous Goods: their identification for the issuance of Consignment Notes (UN number, official transport name, Hazard identification, level of danger, tunnel restriction code).
  • Check for the possible existence of High Risk Dangerous Goods, which would require the application of special provisions to all activities involving this type of goods.
  • Determine the provisions of the regulations applicable to the modes of transport to be used and check the possible shipping restrictions established therein.
  • Check the suitability and authorization of the Equipment and Means of Transport that will be used to transport the Dangerous Goods being shipped, taking into account the Form and Modes of transport that apply.
  • Define the information that must be provided to the Carrier, regarding the Dangerous Goods to be shipped, the method of transport, the Transport Equipment to be used, the data of the parties involved: Recipient, Loader or Filler, etc., which must be sufficient for the Carrier to select the Crew and the Means of Transport: Vehicles, Containers, Tanks.

After starting the shipment

  • Analyze the other companies involved in the expedition: Intermediaries and Participants, especially their capacity to perform the assigned functions.
  • Determine the appropriate measures to ensure that the provisions applicable to the expedition are complied with and that it responds to the applicable provisions of the ADR and the rest of the Regulations and what communications and observations must be made to the Participants who require it, in this regard.
  • Shipper-Shipper Relations (ADR).

Responsible parties of companies that are Participants contracted directly or indirectly by the Shippers.
