Article 32. Security Guards and Their Specialization.
- Security guards assigned to explosives, who must be part of security companies, shall be responsible for protecting the storage, transportation, and other processes inherent to the execution of these services, in relation to explosives or other dangerous objects or substances determined by regulations.
The provisions regarding uniformity, weaponry, and service provision applicable to security guards shall also apply to explosives security guards.
Article 38. Provision of Private Security Services.
- Security guards, explosives security guards, private escorts, and security chiefs shall carry out their professional duties integrated into the security companies that have hired them.
Article 39. Manner of Provision.
- Uniformed private security personnel, consisting of security guards, explosives security guards, rural guards, and their specialties, shall provide their services wearing the uniform and displaying the insignia of their position, and carrying the regulatory defense means, which shall not include firearms.
Exceptions to the obligation to perform their duties in uniform and with identification may be established by regulation.
Article 40. Services with Firearms.
- The following private security services shall be provided with firearms under the terms determined by regulation: (…) b) Surveillance and protection of factories and storage or transportation of firearms, metallic cartridges, and explosives.
Article 44. Security Deposit Services.
- Security deposit services, referred to in Article 5.1.c), shall be provided by security guards and shall be mandatory when the objects in question reach the amounts established by regulation or when the competent authorities determine it based on the history and circumstances related to such objects.
- Security deposit services referred to in Article 5.1.d), shall be provided by explosives security guards and shall be mandatory when they require special surveillance, care, and protection according to the specific regulations of each matter, or when competent authorities determine it based on the history and circumstances related to such objects or substances.
Article 45. Security Transport Services.
Transport and distribution services for the objects and substances referred to in the previous article shall be carried out using vehicles specially equipped for each type of transport or other specific security elements approved for transportation. These services shall involve their physical transportation and protection during transit by security guards or explosives security guards, respectively, in accordance with the provisions of this law and its regulatory development.
